These Terms of Use ("Terms") govern your use of the Wild Tales Journals website and mobile application (together, "the Service") and any order you place with us. Please read them before using the Service. 

By creating an account, placing an order, or using the Service, you agree to these Terms. If you do not agree, do not use the Service. 

Wild Tales Journals is an Australian business. These Terms are governed by Australian law. References to "we", "us", and "our" mean Wild Tales Journals. 

 

1. The Service 

Wild Tales Journals creates personalised printed photo books. Here is how it works: 

 

  1. You connect your iPhone camera roll (or another supported source) and select a time period. 

  1. We ingest your photos for that period. Our AI analyses each photo and selects the 400–500 it determines best represent your year, applying light edits to brightness, contrast, and colour. 

  1. Before your book goes to print, a member of our team reviews the AI's selection. This review is for two purposes only: to check that no explicit or offensive content has been included, and to confirm the overall selection meets our quality standards. The reviewer sees only the selected photos — not your full photo library. 

  1. Your selected and edited photos are sent to our print partner in Singapore, Applied Colours Pte Ltd, who produces and ships your book. 

 

  We do not currently offer a customer review step before printing. You will not see the AI's selection before your book is produced. If you have specific photos you want included or excluded, contact us before placing your order and we will do our best to accommodate your request. 

 

We may change, suspend, or discontinue any part of the Service at any time. We will give you reasonable notice where this affects an existing order. 

 

2. Your Account 

To use the Service you must create an account. You must: 

  • Be at least 18 years old 

  • Provide accurate and complete information when registering 

  • Keep your password secure and not share it with anyone 

  • Notify us immediately if you believe your account has been compromised 

 

You are responsible for all activity that occurs under your account. We may suspend or close your account if you breach these Terms. 

 

3. Your Photos — Licence and Ownership 

You own your photos 

You retain full ownership and copyright in all photos you submit to us. We do not claim any ownership over your original photos or the final printed book. 

 

Licence you grant us 

By submitting photos to us, you grant Wild Tales Journals a limited, non-exclusive, revocable licence to: 

  • Access, copy, process, and edit your photos using automated tools and human review, for the sole purpose of producing your book 

  • Transfer your selected and edited photos to our print partner in Singapore to produce and ship your book 

This licence ends when we delete your photos in accordance with our Privacy Policy. We do not use your photos for advertising, model training, or any other purpose. 

 

Edited photos 

The AI-edited versions of your selected photos (adjusted for brightness, contrast, and colour) are produced for the purpose of your book. Ownership of these edited versions belongs to you. 

 

Book design 

The layout, typography, and design of your photo book are owned by Wild Tales Journals. You receive a physical copy of the book, not a licence to reproduce the design. 

 

Your warranty to us 

By submitting photos, you confirm that: 

  • You own or have the right to use every photo you submit 

  • Submitting and processing the photos does not infringe the rights of any third party, including copyright, privacy, or personality rights 

  • The photos do not contain content that is illegal, explicit, or harmful 

  • Where photos contain images of other people, including children, you have the right to share those images with us for the purpose of producing your book 

If a third party makes a claim against us arising from photos you submitted, you agree to indemnify us for any resulting costs and losses. 

 

4. Acceptable Use 

You must not use the Service to submit photos or content that: 

  • Is sexually explicit, pornographic, or obscene 

  • Depicts or promotes child sexual abuse, exploitation, or any harm to minors 

  • Is defamatory, harassing, threatening, or abusive toward any person 

  • Infringes the copyright, privacy, or other rights of any person 

  • Violates any applicable law 

 

We reserve the right to refuse to produce a book and to cancel your order (with a full refund) if we identify prohibited content during our quality review. 

 

5. Placing an Order 

How an order is formed 

Placing an order through the Service is an offer to purchase. A binding contract is formed when we send you an order confirmation email. We reserve the right to decline any order. 

 

Prices 

Prices are shown on our website and are in Australian dollars inclusive of GST unless stated otherwise. We reserve the right to change prices, but the price you pay is the price shown at the time you place your order. Delivery charges are shown at checkout. 

 

Payment 

Payment is taken at the time of ordering. We accept the payment methods listed on our website. Payment processing is handled by our payment partner; your card details are not stored by us. 

 

Order cancellation by you 

Because your book is custom-made from your photos, production begins shortly after your order is confirmed. You may cancel your order for a full refund if you contact us before production has started. Once production has started, we are unable to accept cancellations, except as required by Australian Consumer Law (see Section 6). 

 

To cancel, email hello@wildtalesjournals.com with your order number as soon as possible. 

 

6. Delivery 

We deliver to addresses in Australia and selected international destinations. Estimated delivery times are shown at checkout and are estimates only — we are not liable for delays caused by our shipping partners or events outside our control. 

Risk in the book passes to you on delivery. If your book arrives damaged, contact us within 14 days with photos of the damage and we will arrange a replacement or refund. 

 

7. Refunds, Returns, and Australian Consumer Law 

  Your rights under Australian Consumer Law (ACL) are not limited by these Terms. Nothing here affects statutory guarantees you are entitled to as a consumer. 

 

Your ACL rights 

Under the ACL, our books come with automatic guarantees that they will be of acceptable quality, match any description we provide, and be fit for purpose. If we fail to meet these guarantees: 

  • For a minor failure — we will repair or replace the book, or provide a refund 

  • For a major failure — you may choose a refund or replacement 

 

Defective or damaged books 

If your book arrives damaged, has a printing defect, or does not match what you ordered, contact us within 14 days of delivery with your order number and photos of the issue. We will offer a replacement or refund. 

 

Change of mind 

Because your book is a custom-made product personalised to your photos, it is not eligible for return or refund on the basis of change of mind. This is consistent with the ACL exemption for goods made to a consumer's specification. 

 

AI selection dissatisfaction 

Our AI makes editorial choices about which photos to select. We do not currently offer a review step before printing. If you are unhappy with the selection in your book, contact us and we will review your situation. Whilst we are not obliged to offer a refund on this basis, we want you to be happy with your book and will consider each case fairly. 

 

8. International Printing 

Your book is printed by Applied Colours Pte Ltd in Singapore. By placing an order, you acknowledge that your selected and edited photos will be transferred to Singapore for printing. We have a Data Processing Agreement in place with our print partner governing how your photos are handled and deleted after production. Full details are in our Privacy Policy. 

 

9. Our Intellectual Property 

The Wild Tales Journals name, logo, website, app, and all content we produce (excluding your photos) are owned by us or licensed to us. You may not use our name, logo, or other intellectual property without our prior written consent. 

 

10. Privacy 

We take your privacy seriously. Our Privacy Policy explains how we collect, use, store, and delete your photos and personal information. By using the Service, you agree to our Privacy Policy, which forms part of these Terms. Our Privacy Policy is available at https://www.wildtalesjournals.com/privacy-policy. 

 

11. Liability 

What we are responsible for 

We are responsible for losses you suffer that are a direct result of us breaking these Terms or being negligent, where those losses are a foreseeable consequence of our breach. 

 

What we are not responsible for 

We are not liable for: 

  • Losses that were not foreseeable when you placed your order 

  • Losses caused by events outside our reasonable control (force majeure), including natural disasters, industrial disputes, or failures of third-party services 

  • Indirect or consequential losses 

  • The content of your photos or any claims arising from photos you submitted 

  • Delays or failures by our shipping partners once your book has been dispatched 

 

Liability cap 

To the maximum extent permitted by law, our total liability to you in connection with any order is limited to the amount you paid for that order. Nothing in these Terms limits our liability for fraud, personal injury caused by our negligence, or any liability that cannot be excluded by law. 

 

12. Changes to These Terms 

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website. Continued use of the Service after changes take effect means you accept the updated Terms. For orders already placed, the Terms that applied at the time of your order continue to apply. 

 

13. Suspension and Termination 

We may suspend or close your account if you breach these Terms, use the Service fraudulently, submit prohibited content, or if we are required to do so by law. We will give you reasonable notice unless the breach is serious or immediate action is necessary. 

You may close your account at any time by contacting us. Closing your account does not affect any order already in production. 

 

14. General 

Governing law 

These Terms are governed by the laws of WA, Australia. Any disputes will be subject to the non-exclusive jurisdiction of the courts of WA, Australia. 

 

Entire agreement 

These Terms, together with our Privacy Policy and Cookie Policy, form the entire agreement between you and Wild Tales Journals for use of the Service. They replace any prior agreements or representations. 

 

Severability 

If any part of these Terms is found to be unenforceable, that part will be removed and the rest of the Terms will continue to apply. 

 

No waiver 

If we do not enforce a right under these Terms on one occasion, that does not prevent us from enforcing it on another. 

 

Assignment 

We may transfer our rights and obligations under these Terms to another business (for example, in the event of a sale or restructure). We will notify you if this happens. You may not transfer your rights under these Terms to anyone else.
