1. Introduction

These Terms of Use ("Terms") govern your use of the Wild Tales Journals website, mobile application, services, and any related products or features (collectively, the “Services”).

The Services are operated by Wild Tales Journals (“Wild Tales”, “we”, “our”, or “us”).

By accessing or using our Services, creating an account, uploading photos, or placing an order, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use the Services.

We may update these Terms from time to time. Updated Terms take effect when published on our website. Continued use of the Services after changes are published constitutes acceptance of those changes.

2. Eligibility

You must be at least 18 years old to create an account or place an order.

By using the Services, you represent that:

  • you have the legal capacity to enter into these Terms;

  • all information you provide is accurate and current; and

  • you have the authority and rights necessary to upload and use all photos and content submitted through the Services.

3. Your Account

You may be required to create an account to use certain features of the Services.

You are responsible for:

  • maintaining the confidentiality of your login credentials;

  • all activity occurring under your account; and

  • ensuring your contact and delivery details remain accurate.

You must notify us immediately of any unauthorised access or suspected security breach involving your account.

We are not responsible for losses arising from unauthorised use of your account caused by your failure to maintain account security.

4. Our Services

Wild Tales Journals creates personalised printed photo journals using uploaded photos and AI-assisted curation tools.

Our Services may include:

  • uploading photos from your device or connected photo libraries;

  • AI-assisted photo selection;

  • journal layout generation;

  • printing and fulfilment; and

  • digital previews and archived projects.

We may modify, suspend, or discontinue parts of the Services at any time.

For MVP and automated-production workflows, journals may be created and submitted for printing without customer review or approval prior to production.

By using the Services, you acknowledge and accept that photo selections, layouts, and suitability decisions may be made using automated systems and limited human quality-control review.

5. AI-Assisted Photo Selection

Wild Tales uses AI systems to analyse uploaded photos and assist in selecting images for inclusion in your journal.

This processing may include:

  • detecting whether faces are present;

  • assessing composition, lighting, sharpness, and variety;

  • grouping similar images; and

  • generating layout recommendations;

Our AI systems do not:

  • identify individuals;

  • create biometric identifiers;

  • perform facial recognition; or

  • build identity profiles.

While we aim to produce high-quality selections, AI-assisted selections are subjective and may not always align with your personal preferences.

To provide AI-assisted curation services, Wild Tales securely uploads low-resolution thumbnail versions of photos within the time period selected by you to Wild Tales cloud infrastructure hosted on Amazon Web Services (AWS). These thumbnails are analysed by automated systems for photo selection purposes only.

Once the selection process is complete, only photos selected for inclusion in your journal are uploaded in high-resolution format for editing, printing, and fulfilment.

Thumbnail images are automatically deleted after selection processing is complete, and high-resolution images are deleted in accordance with our Privacy Policy.

6. Customer Content

You retain ownership of all photos, text, and other content you upload (“Content”).

By uploading Content, you grant Wild Tales a worldwide, non-exclusive, royalty-free licence to:

  • store;

  • process;

  • reproduce;

  • modify;

  • transmit; and

  • use the Content

solely for the purpose of operating and delivering the Services.

You represent and warrant that:

  • you own or have permission to use all uploaded Content;

  • the Content does not infringe any third-party rights;

  • the Content does not violate any laws; and

  • you have obtained consent from individuals appearing in the Content where required.

You are solely responsible for all Content uploaded through your account.

7. Prohibited Content

You must not upload or submit Content that:

  • is unlawful, defamatory, abusive, threatening, or obscene;

  • infringes copyright, trademark, privacy, or other rights;

  • contains malicious software or harmful code;

  • depicts illegal activity; or

  • contains exploitative or abusive material involving minors.

We reserve the right to remove Content, suspend accounts, cancel orders, or report unlawful activity where we reasonably believe these Terms have been breached.

8. Orders and Payment

All prices are displayed in the applicable currency shown at checkout and may change without notice.

Payment must be made in full before production begins.

We use third-party payment providers, including Stripe, to securely process payments. We do not store your full credit card details.

An order is only accepted once we issue an order confirmation.

Because journals are custom-made products, orders cannot usually be cancelled after production has commenced.

9. Printing, Fulfilment and Delivery

Wild Tales journals are printed and fulfilled by third-party print partners located in Singapore.

Estimated production and delivery timeframes are provided as guidance only and are not guaranteed.

You are responsible for:

  • ensuring your delivery address is correct;

  • paying any applicable customs duties, taxes, or import charges; and

  • reviewing your journal carefully before final submission.

Risk in physical products passes to you upon delivery.

10. Refunds, Reprints and Customer Errors

If your journal contains a manufacturing defect, print defect, or shipping damage caused by us or our print partner, please contact us within 14 days of delivery with supporting photographs where possible.

Where appropriate, we may:

  • replace the journal;

  • offer a reprint; or

  • provide another remedy at our discretion.

Because journals are personalised products, we are generally unable to offer refunds or free reprints for:

  • customer spelling mistakes;

  • low-resolution photos;

  • layout design;

  • subjective dissatisfaction with AI selections; or

  • issues visible during the review process before final approval.

Nothing in these Terms excludes rights that cannot legally be excluded under applicable consumer laws.

11. Data Storage and Deletion

We store uploaded photos and associated project data only as long as reasonably necessary to provide the Services.

Our current retention periods are described in our Privacy Policy.

We may delete inactive projects, archived projects, or uploaded Content in accordance with our retention policies.

You are responsible for maintaining your own backup copies of all photos and Content.

12. Intellectual Property

All intellectual property rights in the Services, including:

  • software;

  • branding;

  • logos;

  • designs;

  • layouts;

  • text;

  • graphics; and

  • AI systems

remain the property of Wild Tales or its licensors.

You may not:

  • copy;

  • reproduce;

  • reverse engineer;

  • distribute;

  • resell; or

  • commercially exploit

any part of the Services without our prior written consent.

Wild Tales Journals and associated branding are protected trademarks and may not be used without permission.

13. Third-Party Services

The Services may integrate with or rely upon third-party platforms or providers, including:

  • Apple Photos;

  • cloud hosting providers;

  • analytics providers;

  • payment providers; and

  • shipping providers.

Your use of third-party services may also be subject to those providers’ own terms and privacy policies.

We are not responsible for third-party platforms or services.

14. Availability and Technical Issues

We aim to keep the Services available and secure, but we do not guarantee uninterrupted or error-free operation.

The Services may occasionally be unavailable due to:

  • maintenance;

  • technical failures;

  • internet outages;

  • cyber incidents; or

  • events beyond our reasonable control.

You use the Services at your own risk.

15. Limitation of Liability

To the maximum extent permitted by law:

  • Wild Tales is not liable for indirect, incidental, special, or consequential losses;

  • we are not liable for loss of data, lost profits, emotional distress, or loss arising from AI-generated selections or recommendations; and

  • our total liability relating to any order or use of the Services is limited to the amount paid by you for the relevant order.

Nothing in these Terms excludes liability that cannot legally be excluded under Australian Consumer Law or other applicable laws.

16. Indemnity

You agree to indemnify and hold harmless Wild Tales, its directors, contractors, employees, and service providers from claims, liabilities, damages, and expenses arising from:

  • your breach of these Terms;

  • your uploaded Content; or

  • your misuse of the Services.

17. Suspension or Termination

We may suspend or terminate your access to the Services if:

  • you breach these Terms;

  • we suspect unlawful activity;

  • your use creates security or operational risks; or

  • we are required to do so by law.

You may stop using the Services at any time.

Certain provisions of these Terms survive termination, including intellectual property, liability limitations, and indemnities.

18. Privacy

Your use of the Services is also governed by the Wild Tales Privacy Policy.

By using the Services, you acknowledge that you have read and understood the Privacy Policy.

19. Governing Law

These Terms are governed by the laws of Western Australia and Australia.

You submit to the non-exclusive jurisdiction of the courts of Western Australia.
